- Bring your own device: no plan includes devices. Every plan runs on the tablets and phones you already have. We recommend iPads.
- Optional iPads: refurbished iPads set up with your menu, $450 each, one time, paid before they ship. Not refundable. They are yours: not leased, not rented, and you keep them if you cancel.
- Your devices, your responsibility: Devices are not Easy Light Menu's responsibility. You choose, own and maintain your own tablets and phones. Care, charging, loss, theft, damage and replacement are up to you, including for iPads you buy from us.
- Month to month, every plan: no long-term contract. Cancel anytime by email; cancellation takes effect at the end of the billing period. If you choose to cancel, you have 30 days after your service ends to export your data.
- Missed payments: 5-day grace period. You get a payment reminder every day for 5 days. On day 5, service shuts off completely. Pay what you owe and you're back on, with your data restored and no new contract.
- Optional extras: Auto-Sync Setup, $600 one time (overnight menu updates from your system's nightly spreadsheet export).
- Trivia Night: Trivia Night is rolling out; we'll let you know when it's available.
- Payment: by card through Stripe. Charges show as "Easy Light Menu" on your statement. Prices do not include any sales or other taxes that apply.
1. Agreeing to these Terms
1.1 You accept these Terms when you tick the box that says "I have read and agree to the Easy Light Menu Terms & Conditions" during signup, when you pay for a plan, or when you start using the services, whichever happens first.
1.2 The person accepting these Terms confirms that they are authorized to sign up the business and bind it to these Terms.
1.3 Your plan choice at signup, including any add-ons, iPads you order, and any written quote or invoice we send you (your "Order") form part of this agreement. If an Order says something different from these Terms, the Order wins for that point.
2. Definitions
- "Services" means everything we provide under your plan: your digital menu, QR code, menu page, menu updates, printable menu PDFs, the managed website (if your plan includes it), the language switch and Table Fun software (if your plan includes them), and any add-ons you order. The Services do not include devices.
- "Plan" means the Menu, Menu + Website, or Full package plan you choose.
- "Start Date" means the day your first payment for a Plan is made.
- "Devices" means any tablets, phones or other devices used to show your menu or Table Fun, whether you bought them from us or anywhere else.
- "iPads" means any refurbished iPads you choose to buy from us, set up with your menu, and any cases, chargers or accessories you order with them.
- "Table Fun" means the guest entertainment shown on your Devices, including kids mode, trivia and date-night cards.
- "Customer Content" means material you give us or ask us to publish: menus, prices, item descriptions, allergen and dietary notes, photos, logos, business details and similar information.
- "Guests" means your diners and visitors who view your menu or use your Devices.
3. The Services
3.1 Menu plan ($75/week per location). We build a digital menu from your paper menu photos, PDF or current website. You get a QR code and a mobile menu page (for example, yourname.easylitemenu.com), plus printable menu PDFs.
3.2 Menu + Website plan ($100/week per location). Everything in the Menu plan, plus a restaurant website that we build, host and manage for you.
3.3 Full package plan ($150/week per location). Everything in the Menu + Website plan, plus the language switch and Table Fun (kids mode, trivia and date-night cards). The Full package is Easy Light Menu services only. No devices are included. Bring your own device; we recommend iPads. You may buy refurbished iPads from us separately (see Section 10).
3.4 Menu changes. Send changes by email to the address we give you, with your restaurant name. We aim to publish a clear change request within 24 hours of receiving it, and we confirm by email when it is live. The 24-hour figure is a target, not a guarantee. Large rebuilds, new photography or unclear requests may take longer, and we may ask you questions first.
3.5 Initial build. We aim to build your menu, QR code and (if included) website within 24 hours after we receive your payment and your menu photos or files.
3.6 Auto-Sync Setup (optional, $600 one time). We connect to your register or menu system so that its nightly menu export (a spreadsheet) is sent to us, and your online menu updates overnight. Auto-Sync is not real-time. A change made in your system during the day usually appears the next morning. It depends on your system producing the export, so if the export stops, is late or changes format, your menu will not update until the problem is fixed. You can still email changes at any time.
3.7 Trivia Night. Trivia Night is rolling out; we'll let you know when it's available.
3.8 Changes to features. We may improve, update or replace features, software, designs or hardware models from time to time. We will not take away a core part of your Plan (your menu, QR code or website, as applicable) during a paid billing period without giving you a fair replacement.
4. Fees, billing and payment
4.1 Prices. Plan prices, iPad fees and add-on prices are as listed in the summary box and on your Order.
4.2 How you pay. All payments are made by credit or debit card through our payment processor, Stripe. Charges appear on your statement as "Easy Light Menu". You authorize us, through Stripe, to charge your card for all fees due under these Terms, including recurring weekly plan fees and one-time fees. We never see or store your full card number. Stripe's own terms apply to how it processes your payment.
4.3 When you are billed. Plan fees are billed weekly in advance, per location, starting on the Start Date and then on the same day each week. One-time fees (the iPad fee and Auto-Sync Setup) are charged when you order them.
4.4 One-time fees are not refundable. The $450-per-iPad fee pays for iPads that become yours, and the Auto-Sync Setup fee covers our setup work. Neither is refunded, including if you cancel.
4.5 Keep your card current. You agree to keep a valid card on file and to update it if it expires or changes.
5. Weekly billing; no prepay discount
5.1 Every plan is billed weekly, per location: Menu $75/week, Menu + Website $100/week and Full package $150/week.
5.2 We do not offer a pay-in-full or prepay discount. Plan fees are only charged week by week.
6. Missed payments: 5-day grace period
6.1 5-day grace period. If a payment fails or is late, you have 5 days to pay. We will send you a payment reminder every day during those 5 days. We (or Stripe) may also retry your card.
6.2 On day 5, service shuts off completely. If it is still unpaid on the fifth day, your whole Easy Light Menu service goes dark: menu, QR codes, website, ordering, and everything else. No partial service.
6.3 Pay and you're back. As soon as you pay what you owe, we turn your service back on with your data restored. No new contract or sign-up needed.
6.4 A shutoff is not a cancellation. A shutoff for non-payment is not a cancellation. The 30-day export window in Section 8.6 applies only when you choose to cancel.
6.5 Disputes. If you think a charge is wrong, email us within 30 days of the charge so we can look into it. Please contact us before filing a chargeback with your card issuer.
7. Taxes
Our prices do not include taxes. You are responsible for any sales, use, excise or similar taxes that apply to the Services or the iPads, other than taxes on our own income. If we are required to collect a tax, we will add it to your invoice or charge. If you are tax-exempt, send us your exemption certificate before billing.
8. Month to month and cancellation
8.1 Every plan is month to month. No plan has a long-term commitment. You may cancel any Plan or add-on at any time by written notice (email is fine). Cancellation takes effect at the end of your current billing period. You will not be charged again after that, and the current month is not refunded. We may also end a plan with at least 30 days' written notice.
8.2 iPads are a one-time purchase. iPads you buy from us are not a subscription and are not part of any Plan. Cancelling your Plan does not change your ownership; you keep them.
8.3 No renewal deadlines. Your Plan simply continues month to month until you cancel. There is no yearly renewal and no 90-day notice.
8.4 Changing plans. You may upgrade or downgrade at any time. A change takes effect on your next billing date unless we agree otherwise in writing.
8.5 Our right to end the Services. We may suspend or end the Services if you seriously breach these Terms (including the acceptable use rules in Section 16), if you do not pay (Section 6), or if we are required to by law. If we end your Plan for our own convenience, without any breach by you, we will refund any prepaid fees for the months we do not provide.
8.6 What happens when service ends. Your menu page, QR code destination and managed website will stop working. Any iPads you bought stay with you (see Section 12). If you choose to cancel, you have 30 days after your service ends to export or download your data (menu, photos, and other content you provided). Ask us at steve.holland@easylitemenu.com if you need help. After those 30 days, we may permanently delete your restaurant's data without further notice. Deleted data cannot be recovered. This 30-day window applies only to a cancellation you choose. It does not apply to a shutoff for non-payment (see Section 6).
9. Price changes
9.1 We may change prices with at least 30 days' written notice. The new price applies from your next billing period after the notice period, and you may cancel before then.
9.2 Months you have already prepaid keep the price you paid.
10. Devices and optional iPads
10.1 Devices are your responsibility. Devices are not Easy Light Menu's responsibility. You choose, own and maintain your own tablets and phones. No Plan includes devices. Bring your own device is welcome: every Plan runs on the tablets and phones you already have, and we recommend iPads.
10.1A Optional iPads from us. If you want us to set them up for you, you may buy refurbished iPads from us at $450 each, one time, set up with your menu and paid before they ship. Once paid, the iPads belong to your restaurant. They are not leased or rented, and you keep them if you cancel.
10.2 Management software. If we set up iPads for you, while your Plan is active they may be managed remotely by us so they stay locked to your menu. You agree not to remove, bypass or reset our device management or the Table Fun app, install other apps, or sign the iPads into your own accounts. We may update, lock, locate or wipe the iPads remotely.
10.3 Care. Use your Devices with reasonable care, keep them in protective cases, keep them charged, and store them securely when the restaurant is closed. Staff should supervise their use by Guests, especially children.
10.4 Loss and damage. Because you own your Devices, including iPads you buy from us, you are responsible for them from delivery: care, charging, cases, mounting, loss, theft, damage, and repair or replacement.
10.5 Tell us about managed iPads. If an iPad we manage for you is lost or stolen, let us know within 2 business days so we can lock or wipe it.
10.6 Insurance. We recommend that your business insurance covers your Devices.
11. No device uptime or replacement promise
11.1 We do not guarantee devices. Because devices are not Easy Light Menu's responsibility, we make no uptime, repair or replacement promise for any Device, including iPads you buy from us. Any manufacturer warranty comes from the manufacturer, not from us.
11.2 We still help with the menu. If your menu, QR code, website or Table Fun is not working on a Device, tell us and we will help get the software working again.
12. Your iPads when service ends
12.1 When your Plan ends for any reason, you keep any iPads you bought from us. Nothing needs to be returned. Our menu software and device management come off them, and the iPads are yours to use however you like.
13. Your content and our license to use it
13.1 You own your content. You keep ownership of your Customer Content.
13.2 License to us. You give us a non-exclusive, royalty-free license to use, copy, edit, format, translate, display and publish your Customer Content, and to create menu designs, photo layouts, printable PDFs and web pages from it, as needed to provide and improve the Services. The license lasts while you are a customer and for a reasonable period afterward to wind down (for example, cached pages and backups).
13.3 Your promises about content. You confirm that you own or have permission to use all Customer Content you give us, including photos, logos and trademarks, and that publishing it will not break the law or infringe anyone's rights.
13.4 Editing. We may edit menu wording for clarity, spelling, layout and consistency ("rewrite, balance and polish"). You are responsible for checking the result. If you see an error, tell us and we will fix it.
14. Photos, logos and our materials
14.1 Your logos and photos. Your name, logo and photos remain yours. You allow us to show them in your menu, website and Table Fun.
14.2 Photos we take or create. Photos, graphics or designs we create for you may be used in your menu and website during your service. We keep ownership of our own photos, templates and designs, and may use examples of our work in our portfolio or marketing unless you ask us in writing not to.
14.3 Naming you as a customer. You allow us to list your restaurant's name and logo as a customer on our website and marketing materials. You can ask us to stop at any time by email.
14.4 Our software and platform. The Easy Light Menu platform, software, apps, Table Fun, trivia content, templates and website code belong to us or our licensors. You get a limited, non-transferable right to use them for your restaurant during your service. You may not copy, resell, reverse engineer or build a competing product from them.
14.5 Domains. If you already own your website domain name, it stays yours. If we register a domain for you, we will transfer it to you on request when service ends, as long as your account is paid up.
14.6 Feedback. If you send us suggestions or ideas, we may use them freely without paying you.
15. Your responsibilities
15.1 Wi-Fi and power. You must provide a reliable internet connection (Wi-Fi) and power for your Devices and chargers. Services that depend on the internet will not work properly without them, and connection problems at your location are not our responsibility.
15.2 Accurate prices and allergen information. You are responsible for the accuracy of your menu, including prices, item descriptions, ingredients, allergen and dietary information, alcohol information, and any required health or calorie notices. Please review every menu we publish and every change we make, and tell us about errors right away.
15.3 Menu accuracy disclaimer. We build menus from the information you give us and we try hard to get it right, but we are not responsible for mistakes that come from your information, for changes you did not send us, or for errors you did not report after reviewing your menu. Guests should always confirm allergen and dietary concerns with your staff, and you should keep in-restaurant procedures for this. You, not Easy Light Menu, are responsible for the prices you charge and the food you serve.
15.4 Legal compliance. You are responsible for following the laws that apply to your restaurant, including food labeling, alcohol, advertising, promotions and contests, accessibility, and privacy rules.
15.5 Account contact. Keep your contact email and phone number up to date. Notices we send to the email you gave us count as delivered.
16. Acceptable use
You agree not to use the Services, your Devices or your menu or website to:
- post false, misleading or illegal content, or content that infringes someone else's rights;
- publish content that is hateful, harassing, obscene or otherwise offensive;
- promote illegal gambling, or offer prizes in a way that breaks contest or raffle laws;
- collect Guests' personal information without the notice and consent the law requires;
- introduce viruses or harmful code, attempt to break into our systems, or interfere with the Services; or
- resell or share the Services with another business without our permission.
We may remove content that breaks these rules and, for serious or repeated problems, suspend or end the Services under Section 8.5.
17. Trivia and Table Fun content
17.1 Our content. Trivia questions, games, date-night cards, kids mode activities and related content are provided by us or our licensors and remain ours.
17.2 Accuracy and suitability. We work to keep trivia accurate and suitable for a family restaurant setting, but we do not guarantee that every question or answer is correct or up to date. If you spot a problem, tell us and we will fix or remove it. Kids mode is designed for children but is not a substitute for adult supervision.
17.3 Trivia Night. Trivia Night is rolling out; we'll let you know when it's available.
17.4 Prizes and promotions. If you offer prizes, you are responsible for them and for making sure your trivia promotions comply with Illinois law and any other law that applies, including rules on gambling, raffles, alcohol-related promotions and age limits. Trivia must be free to play and not require a purchase unless the law allows it.
18. Service availability
18.1 No uptime guarantee. We aim to keep your menu page, website and menu software available at all times, but we do not guarantee uninterrupted or error-free service. The Services depend on the internet, hosting providers, Stripe, device and software makers and other third parties that we do not control.
18.2 Maintenance. We may perform maintenance or updates that briefly interrupt the Services. We will try to do this during off-peak hours.
18.3 Third-party services. We are not responsible for outages or changes by third parties, including your POS or register system, your internet provider, hosting companies, Stripe or the makers of your Devices and their software. Your use of those services is governed by their own terms.
18.4 Keep a backup. Keep at least one printed menu or other way to show your menu in case the internet, a device or the Services are unavailable.
19. Disclaimer of warranties
Except for the promises we expressly make in these Terms, the Services and any iPads you buy from us are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise any particular increase in sales, orders, tips or Guest spending.
20. Limitation of liability
20.1 To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or damage to goodwill, even if it was told these were possible.
20.2 To the fullest extent the law allows, our total liability for all claims relating to the Services or these Terms is limited to the fees you paid us in the 3 months before the event giving rise to the claim.
20.3 These limits do not apply to your obligations to pay fees or your indemnity obligations under Section 21, or to anything that cannot be limited by law.
21. Indemnity
You agree to defend, indemnify and hold harmless Easy Light Menu, Holland Tech Incorporated and their owners, officers, employees and contractors from claims, losses, damages, fines and costs (including reasonable attorney fees) brought by third parties that arise from: (a) your Customer Content, including incorrect prices, allergen or dietary information; (b) your food, drinks and restaurant operations; (c) prizes or promotions you run; (d) your breach of these Terms or the law; or (e) injury or damage involving the iPads while in your care, except where caused by our own negligence.
22. Privacy and Guest data
22.1 We handle personal information as described in our privacy practices and as the law requires. We use your contact and billing information to provide the Services, bill you and communicate with you.
22.2 Our menu pages and Table Fun may collect limited, non-identifying usage data (for example, which menu items or games are viewed) to improve the Services and provide you with reports. We do not sell Guests' personal information.
22.3 Payment card data is handled by Stripe, not by us.
23. Governing law and disputes
23.1 These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules.
23.2 Before filing a claim, each party agrees to try to resolve the dispute informally by written notice and at least 30 days of good-faith discussion.
23.3 Any lawsuit relating to these Terms or the Services must be brought in the state courts located in Kendall County, Illinois (or the federal court for the district that includes Kendall County, if it has jurisdiction). Both parties agree to the jurisdiction of those courts. Either party may bring a claim in small claims court if it qualifies.
24. Electronic acceptance, signatures and notices
24.1 Electronic acceptance. You agree that ticking the acceptance box, clicking to continue or pay, or otherwise accepting these Terms online counts as your signature and has the same effect as signing a paper contract. We record the date and time of your acceptance and the version of the Terms you accepted.
24.2 Electronic communications. You agree to receive notices, invoices, receipts and other communications from us by email, and agree that these satisfy any requirement that they be in writing.
24.3 Written notice to us. "Written notice" to us, including cancellation notices, means an email to steve.holland@easylitemenu.com (or another address we give you in writing), or a letter to our business address. Please include your restaurant name. A cancellation notice counts from when we receive it, and we will confirm by email. If you do not receive a confirmation within 2 business days, call or text us at 847-489-5713.
24.4 Notice to you. We will send notices to the email address on your account.
25. Changes to these Terms
25.1 We may update these Terms from time to time. The "Last updated" date at the top shows the current version.
25.2 If we make a material change, we will email you at least 30 days before it takes effect. Continuing to use the Services after a change takes effect means you accept it.
26. General
26.1 Entire agreement. These Terms and your Order are the whole agreement between us about the Services and replace any earlier discussions or proposals.
26.2 Severability. If a court finds part of these Terms unenforceable, the rest stays in effect, and the affected part will be enforced as far as the law allows.
26.3 No waiver. If we do not enforce a right right away, we have not given it up.
26.4 Assignment. You may not transfer this agreement without our written consent. If you sell your restaurant, contact us and we can usually transfer the Plan to the new owner. We may transfer this agreement to a successor business or buyer of Easy Light Menu.
26.5 Events beyond our control. Neither party is responsible for delays caused by events it cannot reasonably control, such as severe weather, power or internet outages, supplier shortages or government action. This does not excuse payment obligations.
26.6 Independent parties. We are independent contractors. Nothing in these Terms creates a partnership, joint venture or employment relationship.
26.7 Survival. Sections that by their nature should continue after service ends continue, including payment obligations, the content licenses needed to wind down, disclaimers, limitation of liability, indemnity and governing law.
